Refunds and Deferrals

At She Speaks Academy, we pride ourselves on delivering high-quality live and online coaching programs with limited spots available to ensure a personalised experience. When you commit to one of our live programs, you are reserving a space that could have gone to another participant. This policy ensures fairness for both the participants and the integrity of the program.

1a. Refund Policy for She Speaks Academy and in-person workshops

In accordance with Australian Consumer Law, we are not required to provide a refund if you change your mind or your circumstances change. However, we understand that unexpected situations may arise, so we offer the following considerations:

  • Refunds will only be issued if your spot can be filled by either:

    • Someone from the existing waitlist, or

    • A suitable replacement that you find to take over your spot.

  • If your position cannot be filled, no refund will be granted due to the limited nature of the program and the inability to resell the spot after the program has commenced or is near commencement.

  • No partial refunds will be issued once the program has started.

1b. Refunds for digital products.

If after 7 days of purchase you are not fully satisfied with your digital product (excludes all She Speaks Academy programmes and in-person events) you will be entitled to a full refund. Please email us hello@nicolejoyofficial.com.

1c. Refunds for She Speaks ticketed events are not offered. Transfers are accepted in writing at hello@nicolejoyofficial.com

2. Deferral Policy

We understand life happens, and sometimes you may wish to defer your enrolment to a future round. Deferrals are permitted under the following conditions:

  • You may defer to a future round of the program only if:

    • Your current spot is filled by someone from the waitlist, or

    • You find someone to take your place in the current round.

  • Deferrals are subject to availability in future rounds and must be used within 12 months from the original start date.

  • If your position cannot be filled, deferral will not be possible.

3. Commitment Expectations

By enrolling in the program, you acknowledge and agree to:

  • Show up fully — whether live on calls or by watching replays — and complete the weekly work.

  • Maintain open communication with me regarding any challenges or support you need during the program.

  • Understand that this program is a collaborative commitment; your success is linked to your level of participation and engagement.

4. Consumer Guarantees

This policy is in addition to your rights under Australian Consumer Law, which guarantees that services must be provided with due care and skill, fit for purpose, and delivered as described. If a major fault occurs on our end, you may be entitled to a refund or other remedies as outlined by the ACCC.

She Speaks Academy Payment Plan Policy

At She Speaks Academy, we offer payment plans to make our programs more accessible while maintaining the integrity and quality of our coaching experience. When enrolling on a payment plan, it is important to understand your responsibilities and the terms associated with this option.

1. Payment Responsibility

  • By selecting a payment plan, you agree to ensure that sufficient funds are available each month for the scheduled payments.

  • Payments will be automatically deducted based on the agreed-upon schedule at the time of enrolment.

2. Failed Payments

  • In the event of a failed payment, you will be notified via email and given a grace period of 3 business days to rectify the issue.

  • If a payment fails three (3) times during the course of the program, you will be removed from the program without eligibility for a refund or deferral.

3. Communication is Key

  • We understand that life happens, and sometimes unforeseen circumstances can impact your financial situation. If you encounter any difficulties with upcoming payments, please communicate with us as early as possible so we can discuss potential solutions.

  • Open communication allows us to support you, but continued non-payment without proactive discussion will result in removal from the program as outlined above.

4. Commitment Expectations

  • Enrolling in a payment plan is a commitment to the full cost of the program. Please ensure that this investment is something you can comfortably manage before signing up.

  • Payment plans are not a pay-as-you-go system; by enrolling, you are agreeing to complete all scheduled payments, regardless of program completion or participation level.

5. Default and Termination

  • Failure to meet payment obligations and/or lack of communication may result in the termination of your access to the program materials, community spaces, and coaching sessions.

  • No refunds or deferrals will be granted in cases of termination due to non-payment.


Emotional Wellbeing & Support Acknowledgement

At She Speaks Academy, we are committed to providing a safe and supportive environment for all participants. Please be aware that during the course, some exercises or discussions may prompt unexpected emotional responses or bring up past memories. This is a normal part of personal growth and confidence-building, especially when working with topics such as public speaking and self-expression.

While every effort is made to deliver content respectfully and sensitively, we acknowledge that each participant’s experiences are unique. If you find any part of the course triggering or distressing, you are encouraged to take a break, step away from the session, or seek additional support as needed.

There is never any pressure to speak about any topics you find triggering and we encourage you to only share stories that you feel comfortable and safe with sharing. Big stories don't necessarily mean big impact and it is not necessary to share stories you are not ready to share.

By participating in this course, you acknowledge and accept that your participation is voluntary and that you are responsible for your own emotional wellbeing. No refunds or deferrals will be approved based on your emotional well-being. If you are not comfortable with this policy, we encourage you not to join.

Liability Waiver & Disclaimer

By registering for and participating in any program, course, coaching, or service offered by She Speaks Academy ("the Academy"), you ("the Participant") acknowledge, understand, and agree to the following terms and conditions:

1. NO GUARANTEE OF RESULTS

She Speaks Academy provides education, coaching, and training designed to enhance public speaking skills. However, we do not guarantee that participation in any of our programs will result in financial success, speaking opportunities, or any specific outcome. Your results are dependent on your own efforts, skills, and external factors beyond the control of She Speaks Academy.

2. WAIVER OF LIABILITY

To the fullest extent permitted by Australian law, the Participant expressly agrees to waive, release, and hold harmless She Speaks Academy, its owners, directors, employees, contractors, and affiliates ("the Released Parties") from any and all claims, liabilities, demands, actions, causes of action, costs, or expenses that may arise from:
a) Emotional distress, mental discomfort, or psychological impact resulting from participation in the program;
b) Any perceived or actual failure to achieve personal, professional, or financial goals;
c) Any decisions the Participant makes as a result of the coaching, training, or guidance provided;
d) Any technical issues, disruptions, or changes to the program structure.

3. PERSONAL RESPONSIBILITY

The Participant understands that public speaking, personal development, and professional growth may involve emotional challenges. The Participant assumes full responsibility for their well-being, decisions, and personal progress. If at any time the Participant feels unwell or emotionally overwhelmed, they are encouraged to seek professional support from a qualified therapist or counselor.

4. NO PROFESSIONAL ADVICE

She Speaks Academy does not provide legal, financial, medical, or psychological advice. Any information shared during the program is for educational purposes only and should not be relied upon as a substitute for professional advice. The Participant is solely responsible for seeking independent advice where necessary.

5. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of [QLD], Australia. Any disputes arising from this waiver shall be subject to the exclusive jurisdiction of the courts in [QLD].

6. ACKNOWLEDGEMENT & AGREEMENT

By registering for and participating in any program offered by She Speaks Academy, the Participant acknowledges that they have read, understood, and agreed to the terms of this policy.
